WaySide Terms of Use

These Terms of Use ("Terms") govern your access to and use of the WaySide application and related services (the "Service").

The Service is operated by Caspean, a sole proprietorship based in Ontario, Canada ("WaySide", "we", "our", or "us").

By creating an account or using the Service, you agree to these Terms.

If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service.

By using WaySide, you represent that:

  • you meet the minimum age requirement
  • you have the legal capacity to agree to these Terms
  • your use of the Service complies with applicable laws

2. Your Account

To use certain features, you must create an account.

You agree to:

  • provide accurate account information
  • maintain the security of your account
  • notify us of any unauthorized access
  • be responsible for all activity under your account

Usernames, display names, and profile photos must not impersonate another person or mislead other users.

3. Description of the Service

WaySide provides tools for organizing travel plans, including:

  • creating and managing itineraries
  • parsing travel confirmation emails
  • uploading and organizing travel documents
  • sharing trips with other users
  • travel suggestions and planning tools
  • AI-assisted itinerary recommendations

The Service is intended to help users organize travel information but does not act as a travel agency or booking provider.

4. User Content

Users may upload or create content within the Service, including:

  • itineraries
  • notes
  • travel documents
  • photos or PDFs
  • shared trip content

You retain ownership of the content you upload.

However, by uploading content you grant WaySide a limited license to:

  • host
  • store
  • process
  • display

your content solely for the purpose of operating and improving the Service.

WaySide does not claim ownership of your content.

5. Responsibility for Uploaded Documents

Users may upload documents such as travel confirmations, tickets, visas, or passports.

You are responsible for:

  • ensuring the legality of documents you upload
  • ensuring the accuracy of travel information
  • protecting sensitive information contained in uploaded documents

WaySide does not verify the validity, authenticity, or legality of uploaded documents.

6. Shared Trips

WaySide allows users to collaborate on shared trips.

When you participate in a shared trip:

  • other participants may view shared itinerary items
  • other participants may view shared documents
  • your contributions may be visible to the group

If you delete your account, certain content you contributed to shared trips may remain visible to other participants but will no longer be associated with your account.

7. Acceptable Use

You agree not to use the Service to:

  • violate any laws
  • upload illegal or harmful content
  • harass or abuse other users
  • impersonate others
  • distribute spam or scams
  • attempt to hack or disrupt the Service
  • scrape or harvest data from the Service
  • create automated accounts or bots

We may remove content or suspend accounts that violate these rules.

8. AI Features

WaySide may offer AI-assisted features that help analyze itinerary items or suggest travel plans.

AI-generated suggestions:

  • may be incomplete or inaccurate
  • should be reviewed by users before relying on them
  • are provided for informational purposes only

9. Accuracy of Travel Information

WaySide organizes travel information but does not guarantee the accuracy of:

  • flight schedules
  • reservation details
  • travel confirmations
  • itinerary information
  • third-party travel data

Users are responsible for verifying travel details directly with airlines, hotels, and other providers.

10. Payments and Premium Features

Certain features of the Service may require payment.

Payments may be processed through:

  • the Apple App Store
  • Google Play
  • other authorized payment processors

WaySide does not store or process payment card information directly.

All purchases are subject to the terms of the relevant platform provider.

11. Service Availability

We aim to keep the Service available but do not guarantee uninterrupted operation.

The Service may be unavailable due to:

  • maintenance
  • system upgrades
  • network issues
  • third-party service outages

WaySide is not responsible for losses caused by temporary service interruptions.

12. Termination

We may suspend or terminate your access to the Service if you:

  • violate these Terms
  • misuse the platform
  • engage in harmful behavior
  • attempt to compromise the system

You may delete your account at any time.

13. Intellectual Property

The Service, including its software, design, and branding, is owned by WaySide or its licensors.

You may not:

  • copy the software
  • reverse engineer the Service
  • reproduce the platform
  • create derivative works without permission

14. Disclaimer of Warranties

The Service is provided "as is" and "as available."

WaySide makes no warranties regarding:

  • accuracy of travel information
  • reliability of AI recommendations
  • uninterrupted access
  • fitness for a particular purpose

To the fullest extent permitted by law, all implied warranties are disclaimed.

15. Limitation of Liability

To the maximum extent permitted by law, WaySide will not be liable for:

  • indirect damages
  • incidental damages
  • consequential damages
  • loss of travel bookings
  • lost data
  • lost profits

If WaySide is found liable for any claim related to the Service, the total liability will not exceed the greater of $100 USD or the amount you paid to WaySide in the past 12 months.

16. Force Majeure

WaySide is not responsible for delays or failures caused by events beyond our control, including:

  • natural disasters
  • internet outages
  • cloud service failures
  • government actions
  • labor disputes

17. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

Any disputes related to the Service will be resolved in the courts located in Ontario, Canada.

18. Changes to the Terms

We may update these Terms from time to time.

When we do, we will update the "Last Updated" date.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
